Terms of Service
Last updated: November 5, 2026
1. Who we are
SendAnchor is a product of ByteVault Enterprise, 18/1 Banerjee Para Road, Barrackpore - Kolkata - 700122, India. In these terms, “SendAnchor”, “we”, “us” and “our” mean ByteVault Enterprise. “You” means the person or organisation that creates a workspace or uses the service.
By creating an account, connecting an SMTP account, or using SendAnchor, you agree to these terms. If you use SendAnchor for an organisation, you confirm that you have authority to bind that organisation.
2. The service
SendAnchor is email marketing software. You connect your own SMTP account and use SendAnchor to manage contacts, build campaigns, send email, run automations, publish forms, and measure results. SendAnchor is not an email relay or an email service provider. Email is sent through the SMTP account you connect, and you pay your SMTP provider directly for sending.
You are responsible for your sending domain, SMTP provider, contact consent, email content, and compliance with all laws that apply to your campaigns.
3. Accounts and recovery keys
You must provide accurate account information and keep your credentials secure. SendAnchor does not send account verification or password-reset email. When you register, you receive a one-time recovery key. You are responsible for storing it safely. If you lose both your password and recovery key, we may not be able to restore access.
You are responsible for activity under your account and for ensuring that team members you invite have permission to access the workspace.
4. Plans, pricing, and payment
Current plans and limits are shown on the pricing page and in Settings. Paid plans are one-time purchases for the commercial life of the SendAnchor service, not for the lifetime of the customer. “Lifetime” does not mean perpetual operation of the service, and it does not override our right to suspend or discontinue the service under these terms.
Prices are shown in US dollars. We may change prices and plan features for future purchases. Free-plan limits may change; we will show the current limits in Settings.
Creem is our merchant of record. Payments for paid plans are processed by Armitage Labs OÜ, Rotermanni 14, Tallinn 10111, Estonia, trading as Creem. Creem handles payment collection, invoicing, sales tax and VAT, refunds, chargebacks, and related payment administration. Your purchase is also subject to Creem’s Buyer Terms shown at checkout. We do not receive or store your full card details.
5. Refunds and chargebacks
If you are not satisfied with a paid plan, email support@sendanchor.org within 14 days of purchase and explain the issue. Eligible refunds are processed by Creem as merchant of record. We may decline a refund where there is evidence of abuse, spam, fraud, a chargeback, or a material breach of these terms.
Paid plans do not renew automatically, so there is no subscription to cancel. If we introduce a subscription plan, you will be able to cancel through the Creem Customer Portal or by emailing support; access will continue until the end of the paid period.
Do not raise a chargeback before contacting us. We will cooperate with Creem on genuine disputes, but chargebacks for delivered services may result in suspension of the workspace while the dispute is investigated.
6. Acceptable use
You may use SendAnchor only for permission-based email. You must have a lawful basis and valid consent for every contact you email, and you must honour unsubscribe requests and suppression lists. You are responsible for complying with anti-spam, privacy, and marketing laws that apply to you, including CAN-SPAM, GDPR, PECR, CASL, and local equivalents.
You must not use SendAnchor to:
- send to purchased, rented, scraped, harvested, or third-party lists;
- send cold or unsolicited email, or email to addresses that did not consent;
- send phishing, malware, spyware, or fraudulent or deceptive content;
- impersonate another person, spoof a sender, or misuse another person’s SMTP account;
- send unlawful, hateful, harassing, sexually exploitative, or otherwise prohibited content;
- evade unsubscribe, suppression, bounce, complaint, or rate-limit controls;
- damage the service, interfere with other customers, or use it to facilitate illegal activity.
We may suspend or terminate a workspace immediately if we reasonably believe it is being used for spam, abuse, fraud, or a legal or deliverability risk. You can report abuse to abuse@sendanchor.org.
7. Your content and data
You keep ownership of your contact lists, email content, templates, and workspace data. You grant us the limited right to host, process, and transmit that content only as needed to provide the service, including sending email through your SMTP account and maintaining suppression and deliverability records.
You are responsible for the accuracy, legality, and consent status of your contact data. You must not upload data that you do not have the right to use.
8. Data protection
For contact data in your workspace, you are the controller and SendAnchor is a processor. We process that data only to provide the service, secure the platform, and comply with law. We use Cloudflare for hosting, storage, and email routing; Creem for payment processing; and Google/Gmail for the support inbox. We do not sell contact data. A data processing agreement is available on request from support@sendanchor.org.
Our Privacy Policy explains what we collect, how we use it, and your rights.
9. Intellectual property
SendAnchor, its software, design, and documentation are owned by ByteVault Enterprise or its licensors. These terms give you a limited, non-exclusive, non-transferable right to use the service for your internal business or personal purposes. You may not resell, sublicense, copy, reverse engineer, or redistribute the service except as permitted by law or by a separate written agreement.
10. Availability and support
We aim to keep SendAnchor available and reliable, but the service is provided on an “as available” basis. We may perform maintenance, change features, or suspend access for security or operational reasons. We do not guarantee delivery, inbox placement, uptime, or fitness for a particular purpose.
Support is available at support@sendanchor.org. We aim to respond within 3 business days. Support does not include legal, tax, or deliverability consulting.
11. Suspension and termination
You may stop using SendAnchor at any time and delete your workspace from Settings. We may suspend or terminate access if you breach these terms, fail to pay, create a legal or deliverability risk, or use the service for abuse. Where practical, we will give notice and a chance to export data. We may delete data after termination in accordance with our retention practices.
12. Third-party services
SendAnchor depends on third-party services, including Cloudflare, Creem, your SMTP provider, and your email infrastructure. We are not responsible for outages, delivery failures, policy changes, or acts of those providers. Your use of a third-party service is governed by that provider’s terms.
13. Disclaimers and limitation of liability
To the maximum extent permitted by law, SendAnchor is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
To the maximum extent permitted by law, our total liability for any claim arising from the service is limited to the amount you paid us for the affected plan in the 12 months before the claim, or USD 100 if you use the free plan.
14. Indemnity
You agree to indemnify and hold ByteVault Enterprise harmless from claims, losses, liabilities, and costs arising from your contact data, email content, campaigns, breach of these terms, or violation of law or third-party rights.
15. Governing law
These terms are governed by the laws of India. The courts at Kolkata, West Bengal, have exclusive jurisdiction, subject to any mandatory consumer protection rights that apply to you.
16. Changes to these terms
We may update these terms from time to time. We will post the updated version on this page and change the “Last updated” date. Material changes will be notified by email or in the product where practical. Continued use after the effective date means you accept the updated terms.
